OpenAI won a partial victory in a copyright lawsuit made famous by comedian Sarah Silverman's lawsuit.

Reuters and The Verge reported on the thirteenth (local time) that a California court partially dismissed a copyright lawsuit filed by five writers, including comedian Sarah Silverman, who claimed that OpenAI's 'ChatGPT' pirated their works. .

In line with this, this lawsuit claims six things. These include ▲direct copyright infringement ▲vicarious copyright infringement ▲violation of the Digital Millennium Copyright Act (DMCA) by deleting copyright management information ▲unfair competition ▲negligence ▲unjust enrichment.

In response to this, Open AI denies the costs aside from direct copyright infringement.

In its decision, the court dismissed 4 claims, including vicarious copyright infringement, DMCA violation, negligence, and unjust enrichment. In other words, it didn’t accept claims of fraud related to illegal business practices and as an alternative sided with OpenAI.

Judge Martinez Holguin identified, “We must prove that the content printed by ChatGPT is substantially just like the content of the authors’ book.” He also said, “We cannot accept the claim that Open AI intentionally removed copyright management information resembling the title and registration number, or the claim that the creator has proven economic damage,” adding, “The claim that there’s a risk of harm to mental property rights in the longer term can be speculation.” “It’s just that,” he said.

Silverman and others can revise and submit their criticism until March thirteenth. The important thing, as identified by the judge, is to prove the similarity between the unique work and the ChatGPT output.

On this trial, Open AI achieved significant results, but there are still many mountains to beat. A representative example is the lawsuit filed by the Writers Guild of America, which incorporates George RR Martin and John Grisham, and the Recent York Times.
